LEGAL
Terms
Last updated: July 2026
These terms govern your use of BrandKernel. By creating an account or using the service, you agree to them. If you are using BrandKernel on behalf of an organisation, you confirm you are allowed to accept these terms for it.
What BrandKernel is
BrandKernel is a guided brand-discovery session. You work through a written dialogue with Ava that turns your thinking into a structured Brand Kernel spanning eleven layers, from Identity through Evidence.
Price and access
BrandKernel is offered as a one-time license of $150, which gives you access to the guided session and your resulting Brand Kernel. There is no recurring subscription.
During our beta, access may be free: we may waive the license fee entirely for beta participants. If a charge applies to your account, it is shown to you clearly before you pay.
Payment and refunds
Payments are processed by Paddle as our merchant of record. Your purchase is subject to Paddle’s checkout terms in addition to these.
As a consumer in the EU, you have a statutory 14-day right of withdrawal for a distance purchase. Because BrandKernel delivers digital content immediately, this right can interact with the standard digital-content waiver, where you ask us to begin, and acknowledge you lose the withdrawal right once delivery has started.
Our refund approach will be stated at checkout and honoured as written there.
Acceptable use
Use BrandKernel for its intended purpose. Do not attempt to break, overload, reverse engineer, or gain unauthorised access to the service; do not use it to produce unlawful content or to infringe anyone’s rights; and do not resell or redistribute access to your account. We may suspend accounts that abuse the service.
Who owns what
You own the content of your Brand Kernel: the answers you give and the identity you build from them are yours to use however you like, including commercially. We claim no ownership over your output.
We own BrandKernel itself: the software, the dialogue method, Ava, the interface, and our branding. Nothing in these terms transfers those to you.
Availability and liability
BrandKernel is provided on an “as is” and “as available” basis. We work to keep it running and to save your progress at every step, but we cannot guarantee it will be uninterrupted or error-free. To the fullest extent the law allows, we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for personal injury or intentional wrongdoing.
Governing law
These terms are governed by German law. Mandatory consumer-protection rights you have in your country of residence are unaffected.
Changes
We may update these terms as the product evolves. When we do, we will update the date above. If a change materially affects your rights, we will make a reasonable effort to tell you. Continued use after a change means you accept the updated terms.
